- W4367551461 abstract "The liberal model for the legal regulation of electronic signatures (in terms of form and content) is favoured by international models, in particular the UNCITRAL Model Law. The legal regulation of electronic signatures in European states (even those with a Germanic legal tradition) is also evolving in this direction, which is probably related to the gradual overcoming of distrust in new signature techniques and technologies. This justifies the conclusion that the Polish legal regulation of the electronic signature should not be stricter than the European standards, reflecting a moderately liberal model of regulation of this signature. This should be a general regulation, representing a minimum intervention in the market for certification services. In particular, this regulation should ensure the security of electronic trading without discriminating against any electronic signature technology or closing off any entity that meets the statutory conditions from providing certification services. Greater freedom in the provision of such services could be counterbalanced by an appropriate legal regulation of the scope of responsibility of entities 'entangled' in the process of using an electronic signature (so-called 'network' liability as a type of tort liability) and the statutory protection of 'informational' privacy (personal data) of persons using an electronic signature. The organisational and legal regulation of trustworthy electronic signatures could go in the following directions: a) limiting the scope of legal rationing to qualified certificate issuers; b) adoption of the principle of voluntary submission to public law supervision; c) designating as the supervisory authority a non-ministerial body of a highly independent and interdisciplinary nature (e.g. the National Commission for Electronic Signatures), which should maintain a publicly accessible list of certification service providers under a public oversight system; (d) allowing the supervisory authority - as is the case in other countries - to outsource certain supervisory functions to technologically specialised private bodies. Excessive rigour in the regulation of electronic signatures in the institutional sphere (infrastructures of mutual trust) can be counterproductive. Instead of resulting in the expected widespread use of this signature (on a par with the ubiquity of the handwritten signature) and increasing the speed of electronic business and the desired flexibility of electronic business (i.e. the smooth uptake of developments in electronic authentication technology), it may lead to rigidity or even blocking of electronic business. Strict conditions regarding the provision of certification services could also result in those interested in using electronic signatures using foreign certification bodies rather than domestic ones. Moderation in terms of rigour is therefore highly desirable. This is encouraged both by the constitutional principle of proportionality in the restriction of rights and freedoms, which undoubtedly applies to the provision of certification services, and by the consideration of the development of international electronic contracting, which can only be facilitated by a legal regulation of electronic signatures that corresponds to international standards (rather than a 'parochial' one, characterised by distrust of the new technology)." @default.
