The results of the study showed that the concept of people with special needs is called people who have had a physical or mental disability as a result of acquired genetic or environmental factors. The category and its care and the lifting of injustice from them, as well as the Yemeni law had the most prominent role in caring for this category and granting them all their rights, according of the results, the study presented a set of recommendations and suggestions. key words: The role of guardians in caring for people with special needs A comparative study in Islamic law- Yemeni law. الملخص: هدفت الدراسة إلى التعرف على أوضاع ذوي الاحتياجات الخاصة ومعاناتهم، وبيان حقوقهم، ودور ولاة الأمور في رعايتهم في الشريعة الإسلامية مقارنة بالقانون اليمني. واستخدم الباحثان المنهج الاستقرائي الوصفي، بالرجوع إلى المصادر الإسلامية مع الأدلة من الكتابِ والسُّنَّةِ، ومعرفة وجهة نظر القانون اليمني. وقد اقتضت طبيعة الدراسة بأن تكون من مقدمة وثلاثة مباحث وخاتمة، وذلك على النحو الآتي: المبحث الأول: تعريف الولاة، وذوي الاحتياجات الخاصة مع ذكر أنواعهم، وأسباب الإعاقة، وتضمَّنَ المبحث الثاني رعاية ذوي الاحتياجات الخاصة ومكانتهم في الشريعة والقانون، بينما تضمَّنَ الثالث المسؤولية الملقاة على ولاة الأمور تجاه ذوي الاحتياجات الخاصة. وبيَّنَتْ نتائج الدراسة أنَّ مفهوم ذوي الاحتياجات الخاصة يُطلقُ على الأشخاص الذين أُصِيبُوا بإعاقة جسدية أو ذهنية؛ نتيجة عوامل وراثية أو بيئية مكتسبة، كما بيَّنَتْ الدراسة- أيضًا- عناية القرآن الكريم والسُّنَّة النبوية بذوي الاحتياجات الخاصة، وبيان حقوقهم وتكريمهم، والقيام بأمرهم، كما أوجبت الشريعة الإسلامية على ولاة الأمور الاهتمام بهذه الفئة ورعايتهم، ورفع الظلم عنهم، وكذا القانون اليمني كان له الدور الأبرز في رعاية هذه الفئة، ومنحهم جميع حقوقهم. وفي ضوء النتائج قدمت الدراسة مجموعة من التوصيات والمقترحات. الكلمات المفتاحية: دور ولاة الأمور في رعاية ذوي الاحتياجات الخاصة، دراسة في الشريعة الإسلامية مقارنة بالقانون اليمني." @default.
