- W4377021508 abstract "Abstract The importance of the so-called human factor for the outcome and accuracy of criminal law and procedure has been acknowledged for a long time but only recently has it been specified and more directly addressed in research. Confirmation bias specifically has been identified as a particularly problematic aspect of human reasoning that impacts on legal actors and criminal practitioners subconsciously. This means that even judges or prosecutors who are expected to be objective, and who may perceive of themselves as objective, may display this form of bias. Following the subconscious nature of confirmation bias, legal actors and criminal practitioners are unlikely to detect and mitigate the bias in themselves. Instead, effective bias mitigation requires scientific evaluations by researchers using established methodologies to evaluate different debiasing techniques." @default.
