I step outside the dichotomy of sovereignty/non-sovereignty, arguing for a notion of <italic>foundational authority</italic> that bears some similarities to, but is not identical with, sovereignty. I locate that authority in the <italic>maiestas populi Romani</italic>. The <italic>maiestas populi Romani</italic> combines law with reverence in a fictional entity that derives from the power of the people (in their sheer numbers), but whose existence is abstracted from any particular assembly of the people. The <italic>maiestas populi Romani</italic>, as a form of foundational authority, is not an institution, a legal formulation, or a person. Rather, foundational authority emerges as a discursive framework within which the collectivity is imagined, laws and institutions created, political obligations defined, decisions made and actions justified, and from which there is no appeal." @default.
