- W4382895839 abstract "자유를 실질적으로 행사하기 위하여 필요한 조건을 평등하게 보장하고 이와 같은 기반 위에서 자유를 실현하고자 하는 헌법의 과제는 헌법 그 자체만으로는 규범력을 실현할 수 없으며, 이를 실현하는 방법을 구체화하는 입법과 지속적인 입법 개선을 통하여 비로소 헌법적 의미를 갖게 된다. 장애인 이동권(移動權)의 문제가 그러하다. 이동권은 대한민국 국민이라면 누구나 자유롭고 안전하게 이동을 누릴 수 있는 권리로, 이동 그 자체만으로도 의미를 갖지만, 인간의 존엄성 실현, 개인의 행복 추구, 교육권 및 근로의 권리 등의 기본권을 실현하기 위한 전제조건이 된다는 점에서도 큰 의미를 갖는 권리이다. 특히, 장애인의 경우 이동권은 그들이 인간다운 생활을 할 수 있는 조건의 형성과 밀접하게 연관되기 때문에, 비장애인에게 적용되던 국가의 기본권보호의무를 그대로 장애인에게 적용할 수 없다. 다시 말해, 비장애인에게 이동권은 헌법 제10조에서 파생되는 일반적 행동자유권을 근거로 국가의 부작위만 있으면 실현될 수 있지만, 장애인의 이동권을 보장하기 위해서는 헌법 제10조 국가의 기본권보호의무 및 헌법 제34조 인간다운 생활을 할 권리를 근거로 하여 저상버스나 특별교통수단을 운행하거나 휠체어가 다닐 수 있는 진입로 및 경사로를 설치해야 하는 등 국가에게 구체적이고 적극적인 작위의무를 부여한다. 장애인의 이동권과 관련해서 지금까지의 헌법재판소 판단은 다른 국가기관의 행위의 합헌성을 심사하는, 즉 부분적, 사후적, 통제적 역할만을 수행하였다. 그러나 장애인 이동권의 실현구조적 차별성과 특수성을 고려한 전향적(轉向的) 판단을 시작한다면, 이제 헌법재판소의 판단은 입법부 등 다른 국가기관의 행위에 지침이자 한계로 작용하여 장애인의 이동권 보장에 실질적 기여를 하게 될 것이다. ‘장애인이 편하면 모두가 편하다.’는 말이 있다. 헌법의 과제인 사회통합을 위해서는 장애인만을 위한 정책이 아닌 장애인을 포함하는, 보편주의에 기반한 정책이 필요하다.
