Изучены и проанализированы имеющиеся в научной литературе точки зрения по поводу процессуального статуса органа дознания ФСИН России. Сделан вывод об избыточности должности дознавателя в структуре уголовно-исполнительной системы, а также явной процессуальной чужеродности дознавателя и его деятельности в рамках пенитенциарной системы. Исследование свидетельствует о наличии достаточного объема имеющихся процессуальных полномочий органа дознания ФСИН России и необходимости закрепления его полномочий не только через Федеральный закон «Об оперативно-розыскной деятельности», но и в результате прямого поименования в УПК РФ. The article raises the question of the completeness of the powers of the body of inquiry in the Federal Penal Service of Russia, the existence of a reference norm in Article 40 of the Code of Criminal Procedure of the Russian Federation and the results of its application. The issue of introducing the position of “investigator” into the staffing of the Federal Penal Service of Russia has been studied. Considered: the possibility of canceling the Instruction of the General Prosecutor of the Russian Federation No. 456/69 of 10/25/2013, the possibility of introducing an indicator similar to that specified in the Order of the Ministry of Internal Affairs of the Russian Federation No. 1040 of December 31, 2013 “the proportion of crimes for which criminal cases have been sent to court in the total number of pre-investigated”. The points of view available in the scientific literature concerning the procedural status of the body of inquiry of the Federal Penitentiary Service of Russia have been studied and analyzed. The conclusion is made about the redundancy of the position of the investigator in the structure of the penal system, as well as the obvious procedural alienness of the investigator and his activities within the penal system. The study indicates that there is a sufficient amount of available procedural powers in the body of inquiry of the Federal Penal Service of Russia and the need to consolidate its powers not only through the Federal Law “On operational-search activity”, but also as a result of direct naming in the Criminal Procedure Code of the Russian Federation." @default.
