Авторы констатируют их сходные черты и различия. Особое внимание обращено на совпадение карательного потенциала принудительных работ и наказания в виде лишения свободы, исполняемого в колонии-поселении. При этом и содержание их, и сущность во многом совпадают. Проведенное исследование позволило определить место наказания в виде принудительных работ в системе уголовных наказаний. На основании статистических данных отражается незначительное количество назначенных наказаний в виде принудительных работ. При этом названы причины их нечастого назначения в судебной практике, в основе чего лежат некоторые аспекты несовершенства законодательства в рассматриваемой сфере. This article reflects the position of the authors regarding the punitive content of punishment in the form of forced labor. Based on the analysis of the criminal and penitentiary legislation of the Russian Federation, the repressiveness of such criminal penalties as imprisonment, corrective labor is considered in comparison with punishment in the form of forced labor. As a result, the authors state their similarities and differences. Particular attention is paid to the coincidence of the punitive potential of forced labor and punishment in the form of deprivation of liberty, serving in a colony-settlement. At the same time, their content and essence largely coincide. The study made it possible to determine the place of punishment in the form of forced labor in the system of criminal penalties. Statistical data reflects a small number of sentences in the form of forced labor. At the same time, the reasons for their infrequent appointment in judicial practice are named, which are based on some aspects of the imperfection of the legislation in the area under consideration." @default.
