• W4386048498 abstract "В статье выявлены этапы развития отечественных историко-правовых исследований, посвященных анализу Конституции СССР 1924 г. Охарактеризованы основные тенденции изучения Основного закона, показана взаимосвязь исследовательских концепций с социальным и политическим контекстом развития государственности и особенностями конституционного процесса. Отмечается, что на первом этапе изучения Основного закона работы теоретиков и практиков государственного строительства были направлены на пропаганду знаний о форме государственного устройства. В 1930–1950-е гг. большинство исследований было посвящено роли И. В. Сталина в создании общесоюзного государства. На третьем этапе в 1960–1980-е гг. была предпринята попытка комплексного анализа развития советской конституционной системы, рассмотрены особенности функционирования органов законодательной и исполнительной власти, правового статуса личности. Современный период характеризуется вниманием к анализу проблем федеративного устройства, а также отдельных правовых норм и их дальнейшей трансформации в отечественном законодательстве. Выявлены основные методологические подходы исследователей Конституции 1924 г. Отмечается, что в советский период внимание исследователей акцентировалось на политических, организационных и законодательных аспектах принятия Основного закона, которые рассматривались в рамках марксистско-ленинской методологии. Сторонники институционального подхода главное внимание уделяют анализу роли Конституции как основного закона государства. The article reveals the stages of development of national historil and legal researches studying the analysis of the USSR Constitution of 1924. The main tendencies of Basic Law study are characterized, the correlation of research concepts with the social and political context of statehood development and peculiarities of the constitutional process is shown. It is noted that at the first stage of the Basic law study the works of theorists and practitioners of state building were aimed at promoting the knowledge of the form of state structure. In the 1930s and 1950s, the majority of studies were devoted to Stalin's role in the creation of an all-union state. The third stage in the 1960s–1980s attempted a comprehensive analysis of the development of the Soviet constitutional system and examined the peculiarities of the functioning of the legislative and executive authorities and the legal status of the individual. The modern period is characterized by the attention to the analysis of the problems of federative structure as well as individual legal norms and their further transformation in the domestic legislation. The basic methodological approaches of researchers of the Constitution of 1924 are revealed. It is marked that in the Soviet period the attention of researchers was focused on political, organizational and legislative aspects of adoption of the Basic law which were considered within the framework of Marxist-Leninist methodology. The proponents of the institutional approach focused on the analysis of the role of the Constitution as the basic law of the state." @default.
