- W4386369055 abstract "The article examines the state-legal mechanism for ensuring freedom of entrepreneurial activity in the conditions of the legal regime of martial law, as well as analyzes the measures necessary to ensure such freedom.It was established that the freedom of entrepreneurial activity does not belong to the absolute rights of a person, therefore it can be subject to certain legally defined restrictions, especially during the operation of the legal regime of martial law.
 It was found that the definition of general temporal, substantive «permits» and «prohibitions» in the sphere of ensuring freedom of entrepreneurial activity at the national level both in peacetime and in wartime is carried out by legal acts of the head of state, parliament, government and central executive bodies, instead «сoncretization» of these «permits» and «prohibitions» in the sphere of entrepreneurship development, as well as its practical support, is carried out by the grassroots vertical of state executive authorities, local self- government bodies and their officials, in particular, by means of their adoption of certain regulatory acts. It was concluded that the state of affairs for ensuring the freedom of entrepreneurship in Ukraine during the legal regime of martial law worsened, compared to peacetime. The reason for this is not only war or gaps or low quality of legal regulation of these relations, but mostly corruption and improper law enforcement practices on the part of public authorities and their officials.A system of steps necessary to ensure the freedom of entrepreneurial activity and to optimize the functionality of the state-legal mechanism in Ukraine in this segment of economic relations is proposed.There are such steps: effective and systematic destruction of corruption; maximum minimization of subject composition and managerial influence in relations related to licensing and documentary support of entrepreneurial activity; autonomous and equidistant from the government, ministries, and other public authorities, independent systematic monitoring of the expenditure of budget funds, investment and other financial resources directed to the sphere of entrepreneurial activity, with the direct participation of public activists and foreign partners; increased responsibility for corrupt activity or any involvement in it; strengthening the requirements for the formation of the judicial corps and its responsibility." @default.
