More specifically, it engages with the role of international court and tribunals in the international legal system and with the inherent ramifications of the conflicting jurisdiction of such bodies. As the chapter establishes, international lawyers conceive of these issues differently, depending on whether they take the position of a legal positivist, a legal idealist or a legal realist. In the case of the role of the international judiciary, this is because legal positivists operate on the basis of a conception of legal validity that is fundamentally different from that of legal idealism, and because legal realists lack such a conception altogether.
