Judicial use of disproportionately harsh words is a known phenomenon. It might be seen as unwarranted, excessive shaming if directed at the parties to the case, but even more so when directed to expert witnesses, counsel, or fellow judges. The legal protections may shield such judicial misbehavior from action, but media coverage of it might harm the judicial image and reduce public acceptance of its rulings. The chapter proposes measures that need to be taken to address unwarranted or excessive shaming. It suggests where and when shaming is a legitimate judicial function, as well as whom judges can, potentially, shame. It also presents the categories where we expect judicial shaming to be problematic. In addition, the chapter looks at the legal remedies currently available for excessive judicial shaming and calls for action through codes of judicial conduct." @default.
