- W4387119673 abstract "Extract The aim of this book, as in previous editions, is to provide an up-to-date comprehensive coverage of the case law in the field of professional regulation and discipline. Together with the Supplement (Chapter 91), I have sought to include all relevant cases up to 17 March 2023. Common abbreviations throughout the book are not spelled out to save space but there is a comprehensive List of Abbreviations. References to Queen’s Counsel (QC) have been retained in cases decided prior to the death of Her Majesty Queen Elizabeth II on 8 September 2022. The abbreviation KC (King’s Counsel) has been used for references in cases decided after 8 September 2022. This fourth edition is divided into 91 chapters and analyses some 2,500 cases across the whole range of professions. There are over 350 new cases since the last edition in 2019. These include important cases dealing with absence of the practitioner and adjournments post-Adeogba, appeals (Sastry and Okpara v. GMC), conviction and caution cases (Wray v. General Osteopathic Council), costs, dishonesty post-Ivey (Maxfield-Martin v. SRA, Gray v. SRA), drafting of charges (Reilly v. Teaching Regulation Authority), findings of fact and credibility (Dutta, Haris, Byrne), impairment and lack of insight, and any knock-on effect on sanction (Awan, Sayer, Towuaghantse, Al Nageim), integrity and conduct in a practitioner’s private life (Beckwith, Diggins v. BSB), and preserving legal professional privilege (Sports Direct v. FRC). On grounds of open justice, the court in Lu v. SRA criticized the practice of ‘sweeping anonymity orders’ of third parties at professional disciplinary hearings." @default.
