Основываясь на анализе содержания наказаний, автор акцентирует внимание на невозможности традиционной систематизации наказаний по причине отсутствия единого критерия (правоограничения), лежащего в основе всех наказаний, не сопряженных с изоляцией от общества. Автор отмечает, что корректировка самого такого правоограничения в большую или меньшую сторону в части объема его реализации, а также дополнение вспомогательными лишениями и ограничениями позволит соотнести уголовные наказания между собой и правильно выстроить соответствующую лестницу. С учетом отечественного и зарубежного опыта, а также на основании собственной гипотезы автор предлагает перестроить систему наказаний и вносит свои предложения. В заключение делается вывод, что вопрос порядка построения наказаний, не связанных с изоляцией от общества, не поддается логическому структурированию по целому ряду причин. В связи с этим требуется внесение принципиальных изменений, предусматривающих дифференциацию наказаний по группам, имеющим определенное целевое предназначение. The article deals with the issue of systematization of the non-custodial penalties` list. Based on the analysis of the punishment content, the author focuses on the impossibility of the traditional systematization of punishments due to the lack of a single criterion (legal restriction) underlying all punishments that are not associated with isolation from society. The author notes that the adjustment of such legal restrictions to a greater or lesser extent in terms of the scope of its implementation, as well as the addition of auxiliary deprivations and restrictions, will allow to correlate criminal penalties with each other and correctly build the appropriate ladder. Taking into account domestic and foreign experience, as well as on the basis of his own hypothesis, the author proposes to rebuild the system of punishments and makes his suggestions. In conclusion, it is concluded that the question of the construction order of non-custodial penalties does not lend itself to logical structuring for a number of reasons. In this regard, it is necessary to introduce fundamental changes providing for the differentiation of punishments by groups having a specific purpose." @default.
