The first person gives medical care, while another accept the treatment.The characteristic contract between the doctor and the patient are :1.There is an agreement from the doctor and the patient.2.There is a legal object.3.There is a cause, that a factor that admire the doctor to give medical care to the patient.Because of Inspannings Principle, so the consequence from that terapeutic contract just attampt to make pregnant. The doctor cannot decide the result matematically-. The prediction result of the Artificial Insemination that is done in the hospital is just 30 %. As a consequence of inspannings principle, if the programme is unsuccesful the patient cannot to fight back the hospital because it has been done as a medical standart.The process of Artificial Insemination technology in elude : planning treatment, twarium stimulation, ovum pick up, spelt,. preparation (washing sperm), insemination in the medium, and transplantation in the endometrium. Before doing that process, the patient needs to know the doctor information that is written in Informed Consent.• The doctor must give attantion to the practice yuridis rule like informed consent and also legal medically aspect about this technology. This legal medicaly aspect consist of three points. They are : Beneficence et nonmaleficence, Autonomy and Justus.The problem of the Artificial Insemination technology and need to solve are surrogate mother, trade of spez-m/ovurn, freezing embrio and the treatment of the stem cell embrio.Program bayi tabung merupakan salah satu contoh teknologi yang dapat memberikan tnanfaat bagi masyarakat. Untuk menggunakan teknologi tersebut perlu ditempuh prosedu•, yaitu mengadakan kontrak terapeutik dengan pihak rumah sakit atau dokter.Kontrak terapeutik adalah pertemuan pikiran (meeting of minds) dari dua orang mengenai suatu hal (solis). Pihak pertain; mengikatkan diri untuk memberikan pelayanan kesehatan sedang pihak kedua menerima pemberian pelayanan tersebut.Karena bersifat hubungan kontrak antara dokter dan pasien, maka hams dipenuhi persyaratan •1.Adanya persetujuan (consent) dad pihak yang berkontrak yaitu antara dokter dan pasien tentang sifat pemberian pelayanan pengobatan.2.Adanya obyek yang dapat dipastikan dan legal.3.Adanya sebab (cause) yaitu faktor yang rnenggerakkan sang dokter untuk memberikan pelayanan pengobatan kepada pasien.Karelia sifatnya inspanings maka perikatan yang lahir dan kontrak terapeutik hanyalah memberikan jasa yaitu yang berupa upaya atau ilchtiar kehamilan yang hasilnya tidak dapat dipastikan secara matematis. Program bayi tabung yang dilaksanakan di suatu rumah sakit hanya memberikan jaminan keberhasilan 30 %. Sebagai perikatan yang bersifat inspanings maka bib jaminan keberhasilan hamil tersebut tidak terwujud maka pasien tidak dapat menggugat rumah sakit sepanjang dokter di rumah sakit tersebut telah melakukan upayanya berdasarkan stndard medik yang berlaku.Sedangkan proses pelaksanaan teknologi bayi tabung secara medis meliputi : pemerilcsaan persiapan, stimulasi indung telur, petik ovum, preparasi sel sperms, pembuahan di cawan petri, dan tandur alih embrio. Sebelum melakukan rangkaian kegiatan tersebut sudah barang tentu diperlukan Informed Consent yang berisi pernyataan memaharni sepenuhrtya penjelasan dokt et.Disamping berpegang pada aturan yuridis praktis seperti Informed Consent, perlu juga diperhatikan aspek mediko lead mengenai teknologi ini yang bertumpu pada tiga asas yaitu untuk berbuat balk (bukan kejahatan), menghargai kebebasan individu serta sesuai dengan kaidah hukum yang berlaku.Masalah yang muncul berkaitan dengan teknologi Ind dan yang perlu pengaturan adalah kontrak rahim (surrogate mother), jual beli sperma/ovum, simpan beku embrio dan penggunaan set tunas janin untuk pengobatan.." @default.
