- W48765467 abstract "Protection Agency's (EPA's) task in assessing and responding to potential groundwater contamination by pesticides is even more difficult. The regulatory authority conferred by the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), 7 U.S.C. §§ 136-136y, for the most part contemplates broad, national, even uniform regulation of pesticides implemented primarily through licensing and use restrictions on product labels, rather than site-specific measures tailored to address localized problems. Growing concern about potential pesticide contamination of groundwater, however, has prompted EPA to develop a comprehensive plan for addressing the issue. In February 1988, EPA issued a document entitled Agricultural Chemicals in Groundwater Proposed Pesticide Strategy. The proposed strategy outlines EPA's planned approach to the generic issues posed by pesticides in groundwater. Four months later, the Agency issued a proposed regulatory decision on the insecticide aldicarb; EPA views that proposal the first 'real world* illustration of its groundwater strategy for pesticides. 53 Fed. Reg. 24,630 (June 29, 1988). EPA has made substantial progress in articulating the general philosophy of its program and striking a balance between the nationwide regulatory approach typical under FIFRA and the flexibility needed to prevent overor underregulation of pesticides in different localities with widely varying groundwater characteristics and agricultural practices. As the Agency begins to shift its focus to the actual implementation of the strategy, however, it is becoming clear that some practical, legal, and procedural problems remain unresolved. FIFRA is essentially a licensing statute that requires that a pesticide be registered by EPA before it may be sold in the United States. A pesticide may be registered if, when used in accordance with any restrictions imposed by EPA, it will not cause unreasonable adverse effects on the environment, a standard that is required by FIFRA to encompass a weighing of the pesticide's environmental, economic, and social risks and benefits. See FIFRA §§ 3(c)(5) and 2(bb), 7 U.S.C. §§ 136a(c)(5) and 136(bb). Any use restrictions that EPA determines are necessary for a pesticide to satisfy that risk-benefit standard e.g., specified application methods, geographical restrictions, precautionary measures, or requirements that the pesticide be applied only by certified applicators who have successfully completed approved state training programs must appear on the product's labeling; it is a violation of FIFRA to use a pesticide in a manner inconsistent with its labeling. FIFRA § 12(a)(2)(G), 7 U.S.C. § 136j(a)(2)(G). If EPA determines that a registered pesticide may cause unreasonable adverse effects, it has the authority to impose further use restrictions or cancel the pesticide's registration.
