One of the primary culprits for this phenomenon is the fear or actual cost of the strict liability imposed upon landowners by the federal Comprehensive Environmental Response, Compensation and Liability Act (CERCLA or Superfund) or its state law equivalents, for the remediation of historic environmental contamination. As Congress has struggled unsuccessfully to date with reforming the adverse impacts of CERCLA, state and local governments have turned their attention to reforms at the state and local level. This is particularly true of the midwestern states under the jurisdiction of die U.S. Environmental Protection Agency (EPA) Region V (Illinois, Indiana, Michigan, Minnesota, Ohio, and Wisconsin, collectively referred to as the midwestern states). The midwestern states have recognized that the only way many contaminated industrial sites will be remediated and developed is if private developers voluntarily undertake this effort. As a result, these midwestern states have put in place programs to encourage the voluntary redevelopment of brownfield sites. While the midwestern states have pursued an aggressive agenda on voluntary brownfield redevelopment, including actions to limit or eliminate the threat of state Superfund liability, the specter of federal Superfund liability at remediated brownfield sites looms. In 1994, EPA began to respond to this state-driven agenda, first at the regional level, then at the national level. In fact, because of the activities within the midwestern states, EPA Region V was one of the first EPA regional offices to respond officially to the issue of brownfield redevelopment. This article takes a broad look at the actions by the midwestern states and the reactions by EPA to encourage brownfield redevelopment including the steps taken to overcome the hurdles posed by Superfund, and to address the financing concerns arising with regard to these contaminated sites.
