- W51041802 abstract "This chapter starts off by examining the criticisms that Brian Tamanaha conveys to many versions of legal pluralism. In particular it mulls over what he defines ‘the Malinowski problem’, which plunges into the difficulties faced by most legal pluralists in trying to ascertain the differences between the social and the legal. Although Tamanaha’s criticisms are worth being carefully considered, the chapter claims that they are not well addressed and that legal pluralists have many strings to their bow to rebut them. Then the chapter calls attentions to Adamson Hoebel’s view of law, which is able to complement and reinforce legal pluralism. The analysis of Hoebel’s thought is also an occasion to examine a key issue, that is, whether or not the difference between the legal and the social can be really found in coercion, as many authors belonging to different fields of study have contended. The chapter concludes that while Hoebel provides a thoughtful analysis as to the way law emerges and functions as a selective device meant to serve some specific tasks, in the end he wrongly posits that only legitimate coercion can really make the difference between legal and generally social rules." @default.
