For the first sixty years of this century, the federal government, primarily through the Bureau of Reclamation, managed massive transfer payments from the federal treasury to dam sites in western river valleys. Local sponsors of water projects, federal engineers, and congressional representatives concocted grand schemes for turning rivers into quiet and cooperative pools that stair-stepped up the river beds. Then, in 1969, with the passage of the National Environmental Policy Act, 42 U.S.C. §§ 4321 et seq. (NEPA), the politics and economics of water resources began to change. While the money was still available, a new set of rules required dam builders to consider environmental impacts. Other new and reinvigorated federal environmental statutes authorized federal agencies including the Army Corps of Engineers (Corps), the Environmental Protection Agency (EPA), the Forest Service and the Fish and Wildlife Service to protect nature and the public interest. Under the new regulatory regime, quickly became the subject of negotiations between dam builders and all those who purported to speak for river protection and natural systems. Theoretically, there was a hierarchy to the mitigation measuresavoiding insults to nature was preferable to replacing in some new location what had been lost. In practice, however, compensation or replacement were the only options seriously considered and negotiations often boiled down to counting picnic tables, parking spaces and outdoor toilets.
