- W577981331 abstract "Federal policy towards regulation of the interstate motor carrier industry has under gone substantive changes in the past dec ade. Overturning a regulatory philosophy of nearly fifty years duration, the Interstate Commerce Commission began significantly liberalizing its regulatory policies in 1977. The statutory basis for regulation was simi larly modified with the passage of the Motor Carrier Act of 1980 (MCA). Many, though not all, of the provisions of the MCA had the effect of ratifying the ad ministrative reforms initiated by the ICC since 1977.1 Some industry observers have thus questioned whether the passage of the MCA of 1980 was even necessary in light of the significant administrative reforms un dertaken by the ICC prior to the passage of the MCA. For example, ICC Chairman George Stafford had previously argued that the provisions of the then-existing Motor Carrier Act of 1938 would allow the ICC to adopt any reforms it deemed beneficial.2 Kahn believed that the ICC s administra tive reforms made regulatory reform a fait accompli. He judged that the 4 4 Interstate Commerce Commission has achieved sig nificant motor carrier regulatory re forms ... no less effectively than statutory revisions would have.3 In his thorough analysis of the provisions of the MCA of 1980, Harper concluded: The Act of 1980 significantly changed the struc ture of economic regulation of the motor truck ing industry... And yet much of what Congress did in the Act of 1980 had already been done, at least in part, or was shortly to be done, by the ICC.4 These observers, however, focused their attentions on descriptions of the legal envi ronment in which the ICC operated. They did not seek to evaluate empirically the ac tual outcome of ICC regulation under the differing legal environments. This paper fo cuses on the latter concern, comparing and contrasting empirically the impact on entry into the motor carrier industry of the admin istrative and legislative reforms. A sizeable literature does exist that analyzes the impact on motor carrier entry of either prereform ICC regulation, the ICC s administrative reforms, or the ICC s policies subsequent to the passage of the MCA.
