- W58403886 abstract "The Alien Tort Claims Act was a part of the Judiciary Act of 1789. It states that the district courts shall have original jurisdiction of any civil action by an alien for a tort only, committed in violation of the of nations or a treaty of the United States (Alien Tort Claims Act, 18 U.S.C. sect.1350). Use of ATCA was not prevelant until 1980 when plaintiffs successfully made a claim under the statute in Filartiga v. Pena-Irala, 630 F.2d 876 (2d Cir. 1980). Since Filartiga, only about 100 cases have been starting using the ATCA.The main area of contention is the qualification of claims which fall under the term law of nations. Courts have thus far decided that quite a few claims fall under the of nations (i.e. customary international law). Those include prohibition of torture, war crimes, etc. Even so, some rights have been deemed not applicable to the of nations (e.g. the right to life and the right to health) and therefore not qualified for a claim under the ATCA.This Note seeks to dissect the problem and present a solution. The federal courts can provide stability and limits to the ATCA by establishing its true purpose, which is to redress claims which are solely international in nature. This can be accomplished by referring to great legal scholars of the past such as Sir William Blackstone and United States Supreme Court Justice John Marshall. Part II of the Note will address background on the general concept of international law, the Alien Tort Claims Act, and the relevant ATCA cases that address tort claims by foreign aliens against transnational corporations. Part III of the Note describes the expanding lists of parties filing suit under the ATCA and the tendencies of the federal courts to expand the reach of the ATCA. Finally, Part IV proposes a solution to the ATCA problem." @default.
