- W588260594 abstract "This is a discussion of construction failures, the need to incorporate safety as a design priority, ethical dilemmas for highway administrators, and the changing views of the courts in respnse to all of these. A historical view is given of discretionary exemption, statutory discretion is discussed, and state tort acts are reviewed. Recent cases are then reviewed. It is noted that failure to maintain a roadway in accordance with its original design can lead to liability. The scope of design immunity is an open issue. Some jurisdictions retain the principle that design immunity is perpetual, and others have adopted the changed conditions qualification. The reasoning in the earlier cases was based on the philosophy that one engaged in a trade or industry should not be held to a higher standard of conduct than that called for in the practices or customs of that trade or industry. However, the courts now accept the arugment that a change in circumstances can support a finding of negligence where the government has failed to make necessary improvements. This finding can be based upon evidence of complaints, evidence of prior accidents, acknowledgements of aging facilities and design shortcomings, or expert testimony calling into question the original design." @default.
