Nine poor, young African Americans were facing death sentences after being convicted of raping two white women in Alabama. The question was simple: were the defendants entitled to effective assistance of counsel in a death penalty trial as part of their constitutional right to due process? On November 7, 1932, Mr. Justice George Sutherland announced the Court’s decision. He first famously declared that defendants in capital cases have the right to the “guiding hand of counsel at every step in the proceedings against [them].” Poor defendants had the right to have counsel appointed if necessary.
