- W60475037 abstract "The article from the law and branch science theory view addresses the problem of relations on the sphere of legal process and legal procedures. Based on the laws of formal logic, considering the history of the approaches to the definition of these concepts development, relying on points of the now renascent doctrine of judicial law, the author comes to the conclusion that the procedure and the process are not synonymous terms but represent two different forms of the law. Process is only an application of substantive law by the court to resolve the legal case essentially whether the procedures are the core of the other law realization forms. The practical significance of this approach is that the procedure cannot be transformed into the process as well as the process cannot adapt the information obtained in the procedures, that is relevant to the court practice in several cases. Violation of this rule also leads to adverse effects in practice: the procedural events are baselessly given the procedural status, which limits everyone’s right to justice and creates justice interference in establishing the truth of the case." @default.
