- W60730576 abstract "This article, which was prepared for a symposium marking the 35th anniversary of Guido Calabresi's The Cost of Accidents, compares Calabresi's theory that punitive damages might be justified as a form of socially compensatory damages with his earlier theory of deterrence in torts. In Ciraolo v. New York (2000) Judge Calabresi, in concurrence with his own opinion reversing a punitive damage award against a municipality, speculated that punitive damages in cases involving multiple victims could be given a new theoretical foundation that would help them avoid the due process scrutiny required by U.S. Supreme Court since BMW v. Gore (1996). According to Judge Calabresi, punitive damages might be justified as providing virtual compensation in cases in which one victim of a defendant's tortious act sues and a class action is not possible. I argue first, that the idea of socially compensable damages fits uneasily within the structure of The Cost of Accidents, since they are neither a cost of an actual accident, as defined under the theory of general deterrence, nor a penalty as defined under the theory of specific deterrence. I argue second that, to the extent that Calabresi's theory of specific deterrence can be modified to accommodate socially compensatory damages, they will not be able to escape the Supreme Court's due process test for punitive damages. I apply Justice Kennedy's comments concerning hypothetical claims in State Farm v. Campbell (2003) to Judge Calabresi's concurrence in Ciraolo and conclude that theory of socially compensatory damages cannot satisfy the minimum requirements for due process. In conclusion, I argue both sides of the current debate over punitive damages have taken a wrong turn by appealing to mathematical ratios in order to justify their application. Neither Calabresi's multiplication of a single plaintiff's damages by the number of hypothetical victims harmed by the defendant, nor Campbell's rule of a single-digit ratio will be able to provide a satisfactory justification for a punitive damage award." @default.
