According to Benedikt Harzl and Daniele Archibugi, a shared legal framework would be necessary, as self-determination cannot be self-assessed by interested parties. Archibugi advocates the emergence of a cosmopolitan legal order and of bodies with the authority of assessing conflicting claims in the area of external self-determination. Looking at existing institutions, the United Nations could provide such a cosmopolitan framework. However, internal divisions in the Security Council have prevented it from taking a final decision concerning the status of Kosovo and from responding effectively to the crisis in the South Caucasus in August 2008, despite Russia’s speedy action to bring the issue of Georgian aggression to the Council. By simultaneously upholding the principles of territorial integrity and external self-determination in exceptional circumstances, member states have paralyzed the U.N.
