- W647291275 abstract "Stream crossings such as arches, bridges and culverts primarily function to facilitate travel over waterways. Structural failures in stream crossings can exacerbate flooding and poorly constructed stream crossings can create barriers to the passage of aquatic life. This paper provides a guide to the myriad of overlapping federal and state wetlands regulations and technical and jurisdictional issues related to stream crossings. Environmental and land used concerns are also explored and addressed with relevant laws and regulations. Stream crossing structures are compared by environmental impacts and costs for construction and maintenance, allowing applicants to assess risk acquisition and development of land parcels requiring stream crossings before making a significant financial investment. Legal challenges for delayed or denied stream crossing permits and potential remedies are discussed. Forty states have adopted laws, promulgated rules or developed technical guidelines or best management practices for stream crossings. Most states express a preference for arches and bridges as stream crossing structures. Federal mitigation rules and state mandates can make any adverse impact to wetlands costly for a permit applicant. The overall costs for construction, required mitigation and long-term maintenance of culverts may make an arch or bridge a more cost-effective as well as environmentally-friendly choice in many cases." @default.
