- W658822591 abstract "Many workplace injuries are not caused by serious accidents, but rather are the result of repetitive stress. This article discusses why employers must conduct suitable risk assessments so that employees are protected from injury. Several recent court cases are summarized to illustrate risks that train operating companies must consider. In one case, a subway train driver sued the London Underground after she developed tenosynovitis due to the prolonged use of a traction brake controller. The employer was found to be liable because it had failed to carry out a sufficient risk assessment, which would have identified the need for an ergonomic opinion on the proper way to hold the brake controller. In a similar case, three train drivers successfully recovered damages after contracting carpal tunnel syndrome. The court found that the defendants had failed to assess the ergonomic risks to the drivers, specifically from upper limb disorders from driving the trains. It was held that if an adequate risk assessment had been conducted, it would have informed the employer that there was a risk caused by poor seats and inadequate arm rests. In a third case, not specifically involving railroads but relevant nonetheless, a claimant sustained a serious cut to his hand while cleaning debris. He alleged that his employers had failed to provide him with suitable protective gloves. If a risk assessment had been properly conducted, the employer would have recognized the specific injury risk, which would have highlighted the unsuitability of the provided gloves. Employers have ongoing duty of care to conduct risk assessments that are compliant with regulations.
