- W67809029 abstract "In the spring of 1997, the American Law Institute approved the Restatement of the Law Third, Torts: Products Liability-a comprehensive work addressing the of commercial product sellers and distributors for harm caused by their products.1 The Third Restatement was published the following year and superseded the revolutionary section 402A, which had articulated rule of in tort more than three decades earlier in the Restatement (Second) of Torts.2 Although section 402A's privity-free rule of products spread, by some accounts, like a prairie fire3 through U.S. courts between the mid-1960s and mid-1980s,4 in the decade since the Third Restatement was published, scholars have noted shift in American jurisprudence: While European and, more slowly, other nations are just beginning to work through the meaning of strict manufacturer in various contexts, heavy preponderance of American jurisdictions, as reflected and guided by the Third Restatement, have returned the bulk of modern manufacturer law to its more natural home in fault.5 In May of 2007, on the eve of the Third Restatements tenth anniversary, The Review of Litigation hosted symposium to address the impact of the Third Restatement, as well as protests against it over the past decade.6 Renowned scholars, litigators, and judges participated in an engaging discussion, now reflected in the articles published in this issue. Jeffrey Kemp and Tom Stilwell joined panel moderated by Tracy McCormack9 to discuss the Third Restatement's impact on seller defenses and duties in the United States. In particular, Jeffrey Kemp focused on the bulk supplier doctrine, the sophisticated user doctrine, and the learned intermediary doctrine,10 while Tom Stilwell addressed the Third Restatement's treatment of post-sale duties.11 Professor Stapleton provided comparative analysis of products law in the U.S. and the EU, in the context of prescription drug manufacturers. She argued in particular that close analysis of the 1985 European Directive on Product Liability may help to avoid a vague rhetoric of liability concerning design and warning claims against drug manufacturers by recognizing that reasonable care by the manufacturer is an answer to such claims.12 A second group of speakers discussed litigation trends confronting plaintiffs in products litigation on number of fronts. Professor Lynn Baker13 discussed whether changing ethics rules governing group litigation and fee arrangements, particularly in Texas, are unduly biased against plaintiffs' attorneys and harmful to the interests of their clients.14 Tommy Fibich discussed the uses and abuses of multi-district litigation cases aggregated in federal courts.15 Fidelma Fitzpatrick offered an in-depth look at public nuisance law as an alternative to traditional products theories in lead pigment and gun litigation.16 Finally, Jennifer Merriman17 provided insight into jury selection in products cases. On the second and final day of the symposium, Professor Steven Goode18 led an esteemed panel of judges, as they provided insight on range of topics including asbestos litigation,19 class actions, and the impact of electronic discovery on litigants and federal dockets, in light of amendments to Rule 26 in the Federal Rules of Civil Procedure. Joining us were Judge Mark Davidson of the llth Civil District Court, Houston, Texas; Justice Dale Wainwright, The Supreme Court of Texas; and Judge Sam Sparks, U. S. District Court, Western District of Texas.
