INTRODUCTION The U.S. Supreme Court has decided that education, one of the most substantial building blocks for progressive and functioning society, is not fundamental right under the protection of the federal Constitution.1 Therefore, it is the privilege of the states to adopt constitutional provisions recognizing the right to public education.2 Brown v. Board of Education? landmark decision regarding education, emphasized that one of the most important functions of state governments is to provide education.4 Today, each state's constitution has provisions concerning public education.5 Consequently, in accordance with states' rights, there is discrepancy among states as to the scope of responsibilities.6 In terms of education, the majority of states have clause in their constitution establishing system of public schools;7 however, the interpretation of beyond tuition varies across states. Some states have extended the meaning of free public education to include school supplies and materials, while others have determined that such items are not included.8 However, state's objective of public is arguably furthered by providing school children with the materials necessary to substantially benefit from this right. This Note compares the range of constitutional interpretations of The beneficial consequences that broad scope of supplying school materials and supplies has on furthering the goals of are discussed. Given these benefits, this Note proposes that state constitutions should be interpreted to include those materials necessary for as part of the word free, as applied to public II. THE SCOPE OF FREE PUBLIC EDUCATION A state's establishment of public as constitutional right signifies its interest in the preservation and furtherance of the underlying goal of maintaining educated, involved citizens. Therefore, allowing school children access to without the burden of financial obligation is valuable notion both to the individual and to society. Examples of various interpretations, from broad to narrow, are provided. A. A Broad Approach: Textbooks and Supplies Included As emphasized here, public involves more than sending child to school. School-acquired requires certain tools to further student's achievement, such as books and supplies.
