The aim of the present study was to examine and evaluate migration connected with trafficking in women and prostitution, labor migration from the new member states, and the landscape of European migration policies.JEL Classification: K12, K31, K33Keywords: labor migration, legal regime, contract law1. IntroductionThis paper seeks to fill a gap in the current literature by examining different aspects of the plurality of distinct coexisting and competing legal regimes, the legitimacy of constitutional democracy in a contemporary pluralistic society, and Shenzhen's rapid rise. Related topics I will explore include Chinese law and legal system, the core of contract law, and the workers embodying London's migrant division of labor.2. Chinese Law and Legal SystemRelational governance may function as a substitute for, or supplement to, weak legal enforcement. Exchange hazards point to the choice of relational governance, not contracts. Social institutions have governed exchanges in China through norms and obligations for thousands of years. Managers seek greater levels of relational governance in response to exchange hazards.1 Chinese law and legal system look remote to foreign lawyers in terms of legal substances. Chinese legal system has an origin of civil law tradition. The contract law may regulate activities of business transactions among civil actors of equal status. In China contract law is the statute adopted by its national legislative body. A contract in China refers to an agreement made by the parties. The contents, goal and formality of a contract should meet the requirements of Conclusion of a contract and effectiveness of a contract stand separately to each other. When a contract is concluded or performed, no social public interest may be damaged. Performance is the core of contract law.2Many of legal principles contained in the Chinese legislation are rooted in Roman The people's courts are granted an independent judicial power under the Chinese Constitution and laws. In China the concept of the rule of law normally refers to as governing the country by law. The law usually takes a formality of general provisions. The parties may agree on the conditions upon which the effectiveness of contract is contingent. The contract performance is prescribed in the Special Provisions of the contract law with respect to specific contracts. A contract, once it becomes effective, must be properly and completely performed.3 The passing of the 1999 Uniform Contract Law (UCL) unified the legislation on contracts under one umbrella statute. The 1999 Contract Law blended elements of civil and common law to create a unified piece of legislation acceptable to both domestic parties and foreign investors. The 2009 judicial interpretation reinforces the importance of judicial interpretations in the Chinese legal system.4 China is facing employment challenges while moving toward a knowledgeand service-based economy. Stringent employment protection legislation is associated with lower employment levels. The momentum for employment growth in China may not be reduced by the new labor contract law.53. Establishing the Legitimacy of Constitutional Democracy in a Contemporary Pluralistic SocietyMigrant workers in China encounter various difficulties and labor abuses. There are laws and regulations that extend a fair amount of protection to rural workers. The Labor Contract Law requires the labor administrative authority to pay damages if its action or inaction causes harm.6 International migration increases as workers move to fill the jobs created by the subcontracted global economy. A relaxation of immigration policy in the late 1990s opened the doors to a supply of potential workers. …" @default.
