- W768650527 abstract "Juris-‐dictionisthe“speakingofthelaw,”theperformativeandenunciatorymodeofnormativity.Astheexpressiveregisterofthelaw,jurisdictionnamespracticesfordeclaring,showinganddeterminingthelimitsandpossibilitiesoflegality.Readintheseterms,jurisdictionposescentrallyimportantquestionstolawandjurisprudencebut,asaprincipleinitsownright,ithasreceivedlittleattention.Contributingtoasmallbutgrowingcriticalliteratureonjurisdictionthisthesiscontendsthatjurisdictionhasauniquecharacterthatdeservescarefultheorising.Takingthecommonlawtraditionasitsprimarysiteofengagement,thethesisarguesthatjurisdictionhasadualaspect,functioningtobothofferagroundforpositiveorformallawandreflectanextantsetofinformalpractices.Inthissense,jurisdictionoperatesasathirdtermforthelaw,mediatingbetweentwolawfulregisters:thepositivelawanda“lawoforiginarysociability.”Iarguethat,thoughattemptingtofixanddeterminethisrelation,jurisdictionismarkedbyambivalenceandinstability.Thisindeterminacy,however,isoftenoverlooked;jurisdictionispresentedasifitweresimplyamatterofsovereignforceorfiat.Ratherthanconceivejurisdictionasanexpressionofthelaw’ssovereignauthority,thethesisarguesthatjurisdictionisaprivilegedpointatwhichwecanseethelaw’sfragility.Jurisdiction,then,isalegaltechniqueopentocriticalinterventionandinterruption.Suchstrategiesofintervention,thatseektooccupyjurisdiction’sfunctionbutarticulateitotherwise,Iname“juriswriting.”MyapproachtojurisdictionisdevelopedthroughthephilosophyofJacquesDerridaandJean-‐LucNancy.Boththinkersunderstandlawtohavetwodistinct,butrelated,senses.Ontheonehand,thereisthelawaspositive,determinativeandviolent,ontheotherhand,lawispresentedasinoperativeandindeterminative,connectedeithertothelawofdifferanceoranontologicalassertionofour“being-‐with”(Mitsein).BothDerridaandNancyreserveaplacefor“law”thatexceedsthepositivelawandis,infact,boundtoitinaparadoxicaldoublebind,bothprovidingitsconditionsofpossibilityanddenyingitsfullefficacy.ThischaracterisationofadoubledaspecttolawprovidesthetheoreticalframeformyunderstandingofjurisdictionandistracedthroughmyengagementswithKafka;thesixteenthcenturyconstructionsofthecommonlaw;jurisdiction’sperformativeanddeclaratorymode;aswellasjurisdiction’sroleinbringingpoliticalcommunityintorelationwiththelaw. TheengagementwithDerridaandNancynotonlyprovidesthetheoreticalorientationforthisstudyofjurisdictionbutrepresentsasecondstrandtotheargumentpursuedinthethesis.MovingawayfromtheLevinasianinspiredunderstandingofdeconstructionandthelawofthe1990s,thethesisseekstoofferamoreholisticreadingofDerrida’swork,drawingonbothhislatertextswithaspecificallyjuridico-‐politicalbent,aswellastheearlierinterventionsonwritingandspeechacttheory.Nancy–particularlyhisontologyof“being-‐with”andhisworkoncommunity–providesausefulsupplementtoDerrida’sthinking.Astheethicalreadingsofdeconstructioninthe1990sturnedtoLevinas,IturntoNancyinordertoforegroundapoliticalcurrentwithinDerrida’swork.ReadingDerridawithNancyallowsmetodevelopasenseofthepoliticalpossibilitiesatstakeinreimaginingjurisdictionalpracticesandtechniques,particularlyimportantformyunderstandingofjuriswriting." @default.
