Mahlum1-The Supreme Court of Nevada, in a 3-2 decision, affirmed a $4.1 million verdict finding Dow Chemical Company liable for negligently undertaking its duty to test completely the safety of silicone.2 However, the court reversed the verdict regarding fraudulent concealment, aiding and abetting and acting in concert, vacating a $10 million punitive damage award. In 1985, plaintiff Charlotte Mahlum received silicone breast implants manufactured by the defendant, Dow Coming, during reconstructive surgery.3 Five years later, she noticed a significant deterioration in her health due, allegedly, to silicone leakage. In 1993, one of her implants ruptured and a portion of the silicone gel became permanently embedded into her muscles and tissue. Subsequently, she developed an atypical autoimmune disease. She filed suit against Dow Coming, Dow Chemical and various other defendants alleging that her disease resulted from the rupture of her breast implant. Dow Chemical owned fifty percent of Dow Coming, held a substantial number of seats on Dow Corning's board and performed silicone toxicology studies for Dow Corning for nearly thirty years.4 Mahlum's claims against Dow Coming were severed, and the various other defendants were dismissed, leaving Dow Chemical as the sole defendant at trial.5 The court held that there was substantial evidence to demonstrate causation, both actual and proximate. The chronology of events (implantation, development of illness, rupture and subsequent worsening of illness) combined with the testimony of three expert witnesses supported a finding of actual cause.6 Likewise, the results of toxicology tests combined with Dow Corning's knowledge that silicone had the tendency to bleed into the patient's breast area supported a finding of proximate cause, or foreseeable harm.7 The court noted that, although causation is a scientifically controversial component of this case, the jury must weigh the proof by a preponderance of the evidence standard and the fact that science may properly require a higher standard of proof before declaring truth does not change the jury standard or the standard to evaluate judgment on appeal..8 The court also held that there was substantial evidence in the record to support the verdict against Dow Chemical for negligent performance of an undertaking. The Court relied on Restatement (Second) of Torts, section 324A to establish the elements of negligent undertaking.9 The court, citing In re Silicone Gel Products Liability Litigation,10 a similar case involving section 324A liability, noted that the key inquiry is whether Dow Chemical undertook to perform services to Dow Corning that Dow Chemical should have recognized were necessary for the protection of third parties. …" @default.
