INTRODUCTION Since his appointment to United States Supreme Court, Justice Clarence Thomas has incited a veritable cottage industry of scholarly output dedicated to proposition that he is a liar who has been false both to his background and to historical events.1 A less charitable sort might view compass of this proposition as excessively cramped and narrow-not one conducive to fruitful research.2 Yet, just as stony ground may still provide shelter for ragweed, so too annual hardy specimens appear elucidating some new manner in which Justice Thomas has once again demonstrated that he is a dissembler unfaithful to his roots.3 The new book, The Real Clarence Thomas,4 slithers comfortably into this niche. The authors adumbrate a purportedly novel twist to liar thesis. Not content with merely raking over dust heaps of Anita Hill imbroglio in search of fine gleanings overlooked by those that have traveled before them,5 authors instead alight upon statements made by Justice Thomas during his confirmation hearings concerning various broad legal topics. The authors then carefully sift these statements and compare them to opinions Justice Thomas later authored or joined on Supreme Court. Through these careful-and not at all feverish or obsessed-lucubrations, authors claim to discover the real Clarence Thomas.6 Based on this analysis, they point out what they believe are Justice Thomas's damning inconsistencies, distortions, and falsehoods that may constitute impeachable offenses and grounds for removing Justice Thomas from bench-thereby banishing him to perdition he so richly deserves.7 Such is tenor of book. This work, however, is of more than momentary interest its publisher promotes it as one of a series of textbooks for undergraduates that explores the multidimensional and multidisciplinary areas of law and politics.8 Hence, given book's purpose and audience, one would surmise that authors would be more than ordinarily diligent in verifying their facts and providing support for their arguments.9 Anything less than rigorous observance of utmost punctilio of objectivity would seem to defeat practical value of what purports to be a textbook for students. The authors recognize this obligation when they acknowledge that although their thesis is controversial, they have still observed Justice Thomas carefully, just as [they] observe all of Supreme Court's justices in course of [their] professional responsibilities for teaching and writing about Supreme Court.10 Despite these claims of diligence, authors did not achieve their purpose. The Real Clarence Thomas is premised on a set of faulty assumptions that have tainted whole. II. A CARDBOARD VILLAIN AND PERJURER The authors assure their audience that Justice Thomas has not been specially singled out for scrutiny, and, indeed, [it] would be possible to study other justices by comparing their confirmation testimony with their judicial opinions, and we hope to do such studies in future.11 The authors simply chose to start with Justice Thomas, because his inconsistencies are uniquely numerous and glaring; not we are pursuing a vendetta.12 Further, authors are willing to suffer slings and arrows of biased reviewers (like myself) who might condemn them as partisan critics, rather than forego far more work to unearth and reveal important questions about Justice Thomas and his veracity.13 One might think-given that thesis of this book concerns alleged lying under oath of Justice Thomas during his confirmation hearings-there would be a long discussion concerning nature of perjury, its elements, proof requirements, and application to impeachment proceedings.14 The book begins, promisingly enough, with a brief discussion about President Clinton's impeachment as a result of Monica Lewinsky scandal. …" @default.
