Given that every country has its own population and tradition, law and drafting procedures of law will be different from country to country. Each country draws up its own set of rules and drafting procedures. The legislative drafting reflects in documents meant to be understood by people who represent target in order for them to be enforced. In many countries, Romania included, but even at level of European Union, regulatory acts projects are submitted for approval together with a statement of reasons, an underlying note or a written report of approval, as well as an impact assessment, according to each case. These statement and motivation tools are either incorporated in act and are published or drawn up separately, their publication being optional.Keywords: legislative technique, legistics, regulatory act, statement of reasons, underlying notes, written reports of approval, statement and motivation tool1. IntroductionIn a democracy, role of law is different than from any other form of organization in a society; that is why norms which regulate its drafting differ accordingly. Legislating is done according to certain procedures, methods and principles which must meet a clear and coherent scientific regulation. These principles, methods and procedures used in legislating process of regulatory acts makes up legislative technique. The legislative technique (or legistics) is art of drafting laws; it is part of legislative science and its aim is to use and enforce options of legislative policies and not only consists in drafting legal text or in its organization (formal presentation, plan, titles, segments etc.) but also in choosing and coordinating way of presenting norms and technical processes.1 Or formal legistics or legislative technique is one which analyzes communication system and supplies principles meant to simplify knowledge of legislative texts.2Christian Lambotte, a renowned specialist in legislative technique issues from Belgium, defined legistics as the research of procedures, rules and formulas destined for a correct drafting and a better understanding of regulatory acts, which tries to reach this goal through harmony, clarity and rejection of unfounded differences.3 The legislative drafting reflects in documents meant to be understood by persons they are destined so they can enforce them.4 So as to assess impact of regulatory acts projects on social, economic and environmental fields, on consolidated general budget, as well as to ensure legislative coherence, presentation and motivation tools are elaborated, such as statement of reasons, underlying notes or written report of approval, depending on act.2. The Motivation of Community Regulatory ActsIn European Union, necessity to improve legislation drafting, that is to draw up clearer and simpler text, observing good practices of legislative technique, has been recognized at highest political level since Edinburgh European Summit (1992). The Council and Commission have taken several measures to meet this need. Those are Council Resolution from June 8 1993 regarding quality of community legislation drafting5 and General guidelines of Legislative Policy Committee, a SEC (1995) 2255/7 document from January 18 1996. These were reasserted through Declaration nr. 39 on quality of drafting of Community legislation, annexed to Final Act of Treaty of Amsterdam. Following this declaration, three institutions involved in adoption procedure of community acts - European Parliament, Council and Committee, have adopted through Inter-institutional Agreement from December 22 1998 common guidelines which aim improvement of community legislation drafting. …" @default.
