- W819322998 abstract "Employers seeking to discipline employees based on chronic absenteeism or use of leave are constrained by the protections provided to employees under the Family and Medical Leave Act (FMLA) and the Americans with Disabilities Act (ADA). Employees who seek or take leave under the FMLA cannot be disciplined for doing so, but employers may still discipline an employee based on related, unprotected absences. Similarly, the ADA prohibits discrimination based on disability of an otherwise qualified individual, and requires reasonable accommodation. These prohibitions may allow an employer to discipline a disabled employee for absenteeism only if the employee's absences render them unqualified to perform, and leave is not a reasonable accommodation or imposes a substantial burden on that employer. Under both the FMLA and the ADA, it is hard to distinguish discipline based on absences from discriminatory treatment based on leave taken under the FMLA or resulting from a disability. Courts should, however, allow the trier of fact to determine whether the employee's protected activity or status entered into the employer's decision to discipline that employee for absenteeism." @default.
