Since that fateful day our altered perception has spawned a national re-evaluation of values, priorities, and policies. Heightened domestic security concerns extend not only to direct threats of terrorism of our populace, but also indirea or collateral threats to our air, water, and basic infrastructure. Before September 1 1 maximizing environmental regulatory transparency seemed the proper trend. Post-September 1 1 the fear that readily available information about our anuclear plants, chemical manufacturers, and other industries and facilities subject to environmental disclosure regulations may be used against us has forced a re-evaluation of the requirements. In the post-September 1 1 world, security concerns are forming an increasing overlay in the field of environmental law. Shortly after September 1 1 , the American Bar Association Standing Committee on Environmental Law began planning a symposium to consider the impact of the terrorist attacks on environmental law, which convened at the American University School of Law on April 12, 2002. Combating Terrorism in the Environmental Trenches, Vol. IX, No. 2, WidenerLaw Symposium Journal 222 (2003), presents selected speeches and papers presented at the symposium, together with articles subsequently written by practitioners and legal scholars who have continued to study the issues. In the Foreword, Professor David Hodas summarizes the ensuing conundrum, Just as we cannot abandon our fundamental values of freedom and democracy in the name of security, so we cannot simply abandon the environmental protection we have achieved in the last 30 years out of a fear of terrorism. In the Overview entitled, Disasters First: Rethinking Environmental Law After September 1 1, Michael B. Gerrard analyzes the legislative response to the September 1 1 attacks against an historical backdrop of similar responses to disaster, then provides an iUuminating risk/benefit comparison between the protections and enforcement of environmental laws and worker health and safety laws. Gerrard observes: Many environmental statutes were enacted, or at least spurred along, in direct response to disasters. The Federal Water Pollution Control Act of 1972 followed from the Santa Barbara Oil Spill; the Emergency Planning and Community Right-to-Know Act (EPCRA) resulted from the chemical gas disaster in Bhopal, India; the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA) was sparked by the Love Canal incident; and the Oil Pollution Act was a reaction to the Exxon Valdez oil spill.
