- W86461350 abstract "A rigid constitution by its very definition is amendable but should not be easily alterable in any fundamental or profound sense. We have opted for a constitutional democracy that has, at its essence, a commitment to the supremacy of the constitution and the entrenchment of the rule of law. A constitutional text that is constant, utilised, reflected upon and interpreted is more likely to lead to a stable constitutional democracy than one that is subject to periodic and sudden changes. The cabinet of South Africa embarked on a review of the institutions established in terms of chapter 9 of the Constitution. It was initially reported that this review was to be conducted under the auspices of the Minister of Public Service and Administration, Ms Geraldine Frazer-Moleketi. Subsequently the matter was referred to a multi-party parliamentary ad hoc committee chaired by Professor Kader Asmal. The terms of reference include determining whether the mandates of these bodies are suitable for South Africa, whether their consumption of resources is justified by the outputs and whether the 'rationalisation of function, role or organisation is desirable or will diminish the focus on important areas. As Chapter 9 institutions are accountable to Parliament and are often required to exercise oversight over the executive, the referral of this issue to Parliament is not only appropriate, but also consistent with the constitutional roles of the relevant role-players." @default.
