This problem plagues all conscientious trial judges, and is one with which many trial judges constantly concern themselves, especially those who sit in courts with an individual assignment system. I believe Church's conclusion?that case management and long-term commitment are two factors essential for delay-reduction programs?is absolutely right. My experience, and I think the experience of most judges who have managed a docket, is that, if courts allow lawyers to control dockets, unnecessary delay?however you define it, and I recognize that the defini tion is a slippery one?will occur. I have had practical experience in two courts on the management of dockets. The question is always court control as against control by the attorneys. My first experience was in the Wayne County, Michigan, Cir cuit Court with its criminal docket in the late 1960s. At that time, the assistant prosecuting attorney in charge of criminal cases for the Wayne County Circuit Court ran the docket. As a result, there were delays of six months to a year in the processing of cases, and cases disappeared because there was no court control over them. The criminal docket, which was a bonanza for defense lawyers, could only be described as chaotic. I am well aware that many criminal defense lawyers encourage delay of criminal trials on the grounds that, if you don't try a person, you can't convict him. Furthermore, as time passes, witnesses disappear, memories become dim, and the likelihood of acquittal increases. Nevertheless, I am convinced that the interests of society and justice require that criminal cases be expeditiously processed and that there be minimal delays. I might note parenthetically that, now that I am a federal judge, the 70-day rule in the Federal Speedy Trial Act is a little too fast, but, nonetheless, it does get criminal cases tried in an expeditious manner.
