- W94654043 abstract "Safe Drinking Water Act (SDWA), 92 U.S.C. §§ 3OOf-3OOj-26, is today, as it was in the beginning, the simultaneous symbol of what is wrong with federal regulation and why we need it. It is appropriate, of course, for the federal government to legislate in the interest of public health. Indisputably, though, federal legislation is not always the best way to balance local risks against local budgetary constraints. The SDWA illustrates this point, because in the SDWA, many local governments perceive little balance. Despite language in the statute directing some consideration of economic feasibility of drinking water standards, the U.S. Environmental Protection Agency (EPA) draft rules threaten to burden the states' drinking water programs to the point of collapse. Yet EPA is not being overzealous; the SDWA mandates at least this level of rulemaking. The result of EPA's carrying out its statutory mandate is the potential for some communities to have no drinking water program at all, instead of having substantial (though imperfect) protection of water quality. Although opposed by the Ford administration and the National Governor's Conference, the SDWA was passed by Congress in December 1974 as the tide of public opinion crested following the release of two reports a month earlier linking organic chemicals found in drinking water supplies with cancer mortality. Congress was also concerned with the threat of loss of groundwater resources as a source of drinking water because of contamination from unregulated underground injection. Thus, the SDWA created programs for underground injection control and sole-source aquifer protection. SDWA required EPA to: (1) establish water quality standards or treatment techniques to avoid human health risks; and (2) establish drinking water system monitoring requirements and operational standards." @default.
