- W95722605 abstract "Any attorney involved in litigation against a corporate adversary would love to be able to interview employees and former employees of the company without the presence of corporate counsel. Such informal interviews would not only be much cheaper than formal discovery through depositions but would presumably be more fruitful in terms of obtaining admissions against the corporation's interest. Counsel would particularly like unfettered access to former employees, hoping that a disgruntled ex-employee would spill the beans on his former employer. While most counsel immediately will recognize the tactical advantages of ex parte contact with employees and former employees, counsel may be slower to recognize the sometimes difficult ethical issues raised by these contacts. Despite the importance of this issue in the everyday of corporate litigation, the ethical rules regulating ex parte contacts with employees and former employees are not clear. Courts have reached conflicting conclusions with respect to the propriety of ex parte contacts with employees and former employees. This article analyzes the ethical rules and court decisions discussing the propriety of ex parte contacts with current and former employees of a corporate adversary. The article recommends the recognition of a clear rule forbidding ex parte contacts concerning a subject of controversy with current employees of a corporate party to the controversy. The article also recommends rules with respect to the circumstances in which ex parte contact with former employees of a corporate adversary is proper." @default.
