• W960727259 abstract "Enterprise in the draft of the general part of the Civil Code of the Republic of Poland of 1928–1932The subject of analysis are the legal regulations on enterprise in the draft of the general part of the Civil Code of 1928–1932, whose author referent of the Codifi cation Committee of Poland was professor Ignacy Koschembahr-Łyskowski 1864–1945. The author of the article analyzes the overall objectives of the draft of this part of the Code, which was based on a rejection of the idea of individual rights and was difficult to reconcile with the majority of drafts of Codification Committee of the Second Republic of Poland. He indicates that enterprise was placed in the provisions of the general part of the Code relating to legal items, based on a broad concept of legal items and the subject of rights in rem. In the French court judiciary referent Łyskowski noticed a tendency to treat the general relations of monetary value, which a person finds himself, as a property, which could be the subject of property, considered by the doctrine as the universitas iuris. This was to be confirmed also in the Austrian legislation. The referent constructed enterprise as the property of entrepreneur, and as the property which explicitly refers to differentiation of enterprise in civil law, the essence of which could not depend solely on business activities of entrepreneurs and on enterprise in commercial law. The author of the article argues that the legal regulations on civil enterprise included in the analyzed draft were not exhaustive, could sometimes cause problems of interpretation, moreover did not always suit the trends expressed in the legislation of the Second Republic of Poland.Das Unternehmen im Entwurf des Allgemeinen Teils des Zivilgesetzbuches der Republik Polen aus den Jahren 1928–1932Gegenstand der Uberlegungen sind die rechtlichen Regelungen betreffend das Unternehmen in dem Entwurf des Allgemeinen Teils des Zivilgesetzbuches aus den Jahren 1928-1932, dessen Autor Prof. Ignacy Koschembahr-Łyskowski 1864-1945, Redner der Kodifi kationskommission der Zweiten Polnischen Republik, war. In dem Beitrag wurden die allgemeinen Grundsatze dieses Entwurfes analysiert, der auf der Ablehnung der Idee der Personenrechte begrundet wurde, einer Idee, die sich schwer mit der uberwiegenden Zahl der Entwurfe der Kodifi kationskommission der Zweiten Polnischen Republik vereinbaren lies. Er weist darauf hin, dass das Unternehmen in den Vorschriften des allgemeinen Teils des Gesetzbuches betreffend Sachen platziert wurde, der auf einer breiten Auffassung einer Sache und des Gegenstandes der Sachenrechte basierte. In der franzosischen Rechtsprechung hat der Redner Łyskowski die Tendenz erkannt, die Gesamtheit der geldwerten Verhaltnisse, deren Partei eine Person ist, als Vermogen zu betrachten, das Eigentumsgegenstand darstellen kann, das durch die Lehre fur universitas iuris gehalten wird. Auch in der osterreichischen Gesetzgebung sollte das seine Bestatigung gefunden haben. Der Redner gestaltete das Unternehmen als Eigentum des Unternehmers, als ein Vermogen, was deutlich an die Unterscheidung zwischen dem Unternehmen laut Zivilrecht, dessen Wesen ausschlieslich in der Tatigkeit des Unternehmers nicht liegen konnte, und dem Unternehmen laut Handelsrecht anknupft. Der Verfasser beweist, dass die rechtlichen Regelungen des analysierten Entwurfes betreffend ein Unternehmen nach burgerlichem Recht nicht ausreichend waren, manchmal zu Auslegungszweifeln fuhren konnten und daruber hinaus nicht immer den Tendenzen entsprachen, die in der polnischen Gesetzgebung der Zweiten Polnischen Republik ihren Ausdruck fanden." @default.
