After a lengthy trial, which itself had followed years of civil discovery on remedy-related issues, Judge Phillips rejected the government's remedy in favor of one proposed by a group of potentially responsible parties (PRPs) liable to remedy the contamination at the Hardage toxic waste site near Criner, Oklahoma. The government, which had the most to lose from this ruling, yawned. At public meetings and seminars, government lawyers downplayed its significance. Hardage, the government argued, was a dinosaur, a relic from the days when the Superfund program was in its infancy and the government routinely filed actions for injunctions under section 106 of the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA), 42 U.S.C. §§ 9601-75, asking courts to enjoin PRPs to clean up waste sites. The government filed those cases without having selected a remedy. Most courts viewed their own role as one of selecting the appropriate remedy after a de novo factual hearing.
