- W99220692 abstract "This paper analyzes the Abandoned Shipwreck Act of 1987, a topic at the intersection of admiralty and historic preservation law. I conclude that, despite Congress’s best intentions in creating the law, the Act has been a failure. Practically, the Act disserves the cause of historic preservation by creating an inconsistent patchwork of state management schemes, and by failing to create incentives for discovering new shipwrecks. More importantly, the Act violates the United States Constitution by restricting the federal courts’ admiralty jurisdiction and by disrupting the national uniformity of admiralty law.These problems - in particular the constitutional ones - are especially evident in light of developments in Supreme Court admiralty law. The Court has never addressed the Abandoned Shipwreck Act’s provisions head-on, but recent decisions have nevertheless severely undermined the Act’s constitutionality, which was questionable from the start. Unfortunately, those developments have been overlooked by academics and lower courts alike. The literature lacks a comprehensive presentation of the argument against the Act’s constitutionality, and my intention in this paper is to respond to that lacuna. However, I also reemphasize the importance of protecting our nation’s historic shipwrecks, and propose two solutions which might improve American shipwreck law, both constitutionally and practically." @default.
